I have read and agree to this release of all claims, waiver of liability and assumption of risk (“Waiver and Release”) and provide it to The Backstage Blonde LLC including its employees, tour guides, and representatives (collectively “TBB”) as a condition of my participating in the tour.  

I accept full responsibility for my behavior, well-being, and health throughout the tour and that of any children in my care.  If I purchase a ticket for a child on the tour, then I or the child’s parent or guardian will accompany the child on the tour and be solely responsible for the child’s care and safety. 

I understand that the tour may involve walking through unfamiliar congested sidewalks, crossing busy streets, and navigating staircases. I knowingly and willfully accept these risks. I am aware that in addition to the usual dangers and risks inherent in a tour, this tour may have certain additional dangers and risks, such as: physical exertion for which I may not be prepared; uneven sidewalks and potholes in streets; icy sidewalks and streets; and, sudden weather changes. I accept all the inherent risks of the proposed tour and the possibility of personal injury, death or property damage or loss resulting therefrom. I acknowledge that the enjoyment and excitement of the proposed form of tour is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and these inherent risks contribute to such enjoyment and excitement, being a reason for my participation. I agree at all times during the tour, to comply with any instructions given by TBB and I accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance may result in my removal from the tour.

I waive any and all claims I may have now and in the future, and release from all liability and agree not to sue TBB for any personal injury including death, property damage, or loss sustained by me as a result of my participation in a TBB tour due to any cause whatsoever, including without limitation, negligence on the part of TBB, its tour partners, or other participants, or death or injury as a result of civil unrest or epidemic. I further agree that if I violate this agreement and attempt to assert a claim or bring suit against TBB, that I will be responsible for TBB’s attorney’s fees and any costs incurred in defending such action.

In entering this Waiver and Release, I am not relying on any oral, written nor visual representations or statements by TBB or any other inducement or coercion to go on the tour.  I acknowledge that my participation in this walking tour is purely for informational and recreational purposes. 

I agree that TBB is not liable for any inaccuracies its website. I agree not to copy any portion of the TBB website without the written permission of TBB.

TBB makes every effort to begin and end tours on time. Information may be altered at any moment in the event of circumstances outside our control. These circumstances include, but are not limited to, traffic, pedestrian congestion, weather, and construction. 

TBB reserves the right to cancel tours at any time in which case tour refunds or exchanges will be issued.. Prices are subject to change without notice. 

I agree to grant The Backstage Blonde LLC a worldwide, royalty-free, perpetual license to use my photographic, video, or digital likeness for promotional, educational, and/or commercial purposes. By purchasing the ticket(s), I affirm that I have fully understood and agree to these Terms and Conditions and Waiver and Release of Liability.
